CESTAT representation
CESTAT is where a large part of India’s indirect tax jurisprudence is actually settled. Our advisor argued before it for 19 years on the Revenue’s side and has argued before it since 2012 on the taxpayer’s — an unusual combination in this field.
What this covers

- Stay applications and pre-deposit under Section 35F
- Cross-objections, including maintainability questions
- Classification, valuation and CENVAT credit disputes
- Clandestine removal allegations
- Remand proceedings and consequential relief
- Rectification of mistake and restoration applications
Why clients bring us this work
As Departmental Representative, our advisor argued that a defective Revenue appeal was maintainable as a cross-objection under Section 35B(4). The Chief Commissioner (AR) circulated that order to all Departmental Representatives and the position was adopted nationally — a procedural point that continues to affect how appeals are handled.
Related matters from our advisors' case record
A Customs penalty of Rs 1 crore for alleged abetment of smuggling was successfully challenged. The Tribunal reduced it to Rs 5,000 after accepting that the duty said to be evaded was unquantified.

Common questions
What is pre-deposit and can it be reduced?
Section 35F requires a percentage of the disputed amount to be deposited before an appeal is heard. The computation is frequently disputed — particularly what forms the base amount when penalties and interest are involved — and getting that right at filing avoids an early and avoidable defect.
How long does a CESTAT appeal take?
It varies considerably by bench and subject matter, and we would rather give you a realistic view of your specific matter than a general figure. What is within your control is the quality of the record carried up from adjudication, which is often what determines whether a matter is decided or remanded.
